Dear forum friends,
Could someone back me up if I state that NO SALES is allowed within EU-countries whenever a CE certificate has expired? Not even if the products were produced during a valid certificate?
In other words, The certificate is your passport to sell, and not to produce the goods.
Next to that, are there any limitations to sell outside the EU-countries?

Interestingly, despite my requests in the previous months, my NB allowed my old CE Certificate to expire and there was a 4 day gap before the new one was issued.
I have asked them to comment on our status in the period, and will let you know what they say.

A CE certification has two aspects to it.
One - the product is produced to meet various standards and protocols applicable to it. No certification means no guarantee of continuing to meet thes requirements - no CE mark on the product - no selling in EU.
Two - You or your representative, with an office in the EU are guranteeing to shoulder any liability that may arise due to defective product. If your product was made with a CE mark but now you dont accept any liability, you cant sell in EU.
If you continue to accept the liability, you logically can. I dont know how you would be expected to prove or certify that.
Outside EU, you CE is not a regulatory requirement. You need CE only if your customer wants it. He will decide whether he wants to buy if the certificate has expired.

It is getting more clearly.
Still the question is if we are allowed to sell the products within the EU if our certificate has expired.
We don't want to extend the certificate, as the product is fasing out.
Next to that we want to prevent additional regulatory costs for the remaining stock. Of course we would like to sell the products and we have an opportunity to do so in the EU.

I contacted my NB and according to them is it no problem to sell the products as long as they are manufactored under a valid certificate. Thanks for your thoughts and comments.
