Steve,

What qualifications does your AS9100 auditor have with the ITAR?


Our auditor tried the same line with me, and when I pulled out the ITAR, he could not find anywhere the requirement that a Birth Certificate or Passport was a requirement to be verified.

Exactly right. I know that AS9101 mentions ITAR, but QMS auditors have no business in policing ITAR/EAR or other issues they have no competence in.

The auditor was out of line. What did he say when you asked to see his passport?
But to answer your question: You need a system that is commensurate with the risk. I have a policy which asks if the visitor is a US citizen or not. If the visitor states that they are a US citizen, (as defined in ITAR) they are asked to sign an acknowledgement that they understand ITAR and will abide by it.
If the visitor does not qualify, or will not sign the acknowledgement, their access is restricted. (Restrictions are defined in the policy.)
On the other extreme, I know of some companies which will not let you in without your passport (or similar). (But this is not because of AS9100).

Showing identification is not a requirement in ITAR, merely a way of showing that you attempted to comply.
In our facility, Visitors are escorted regardless including auditors, vendors, salesman, interviewees etc.
Restricted material is not kept on public display and visitors are not allowed the use of cameras, phones, etc. while in the facility without prior arrangements.

We pay the auditors to poke holes in our system. AS9100 addresses meeting all other regulatory and statutory requirements.

If the auditor wants to write something like that up as anything more than an observation, they should be an expert in that case. If they want to casually mention it during the audit, thank them.

Correction: The role of an AQMS audit is to audit the facility for compliance to requirements - not to "poke holes in our system". Once the auditor is satisfied that you are aware of ITAR and making the best effort to comply with those requirements the his functions fulfilled.

In this case - I agree, the auditor overstepped his boundaries by pretending to be an expert in another field - thus - out of line.

You can apply for a DSP-5 for non-U.S. Persons, with prior notice of course.
