NCR or Not - Electricity from the distributor is not consistent

Hi there

I have noticed that supply of electricity from the distributor is not consistent and which is badly affecting my business. When I complained, distributor told me that it is not because of their fault. The branches of trees falling on distribution lines frequently and badly affecting efficient power transmission. Then distributor representative showed the copy of complaint from their side to forest department to cut the branches or remove the trees from nearby power transmission lines. So far there is no action from forest department side and the power distribution company can’t do anything as forest department comes under state administration. Is this case has enough reason to get an NC for power distributor?If it is not an NC,why?

It is simple - If you have requirements, and these requirements are not satisfied there is NC.

Have you and the power distributor got into a contract for clean and continuous power supply by the distributor 24x7 days irrespective of any external factors , man made or natural ... ?
If yes >> NC
If not >> No NC

it will be highly helpful if you could give the corresponding clauses to point out the violation for an NC.

It is simple - If you have requirements, and these requirements are not satisfied there is NC.

There is no written contract between me and power distributor.I had a meeting with their business development executive before applying for a connection.That time, he verbally agreed 24x7 supply of power.I have recorded this verbal conversation without his knowledge. Moreover their business leaflet also claims 24x7 power supply.That is why I choose their service.

May I ask you if you have also some 'Terms and conditions' stated in writing by the power distributor when you went for their service. Marketing claims and business leaflets are not contractual documents, though the service provider vouch by it and will do all that they can to meet it. In fact your power distributor is also doing the same.
If you NC him, he will support his CA with the copy of complaint from their side to forest department to cut the branches or remove the trees from nearby power transmission lines. What next ?

What are the criteria you are going to use to report the NC against? We might agree that there is a non-conformity, but it's important to have some for of basis for reporting it. For example, if a product is defective, it's the design specification the NC is issued against - the drg number. If you want to know an answer, you have to supply more information about the contract, terms, their service description or similar.

What position do you hold in your organization? Are you the owner? I'm not sure the recording is of relevance - in the USA you can't use a secret recoding as evidence of anything.
