US Risk Assessment OH&S Regulatory Requirement(s)

Graruss

In the UK and Europe there are many pieces of legislation which set out the requirement to carry out risk assessments. What is the legal position in the US regarding the requirement to carry out risk assessments?

The OP chose the occupational H&S Management Standards forum to place the question, so, I suspect s/he is aiming at regulatory requirements in the USA related to OH&S that would have a risk-based intent.

Most of the OH&S regulatory requirements in the US come from OSHA. I am not very familiar with their regulatory requirements, but I do not believe that they embed the concept of risk management in them.

Sidney is correct, risk assessment is not mandated (required) under OSHA and any requirment to do so would result in screaming, shouting and near blood-letting, not to mention court injunctions, lawsuits and threats from employers and employer rights groups.

Hello !

Identification and analysis of potential risks to safety and health at work of employees and yet the fundamental basis of any prevention approach (risks in current working situations, or risks in predictable working situations if a project).

In Europe, occupational risq assessment legal requirements are comming from our 89/391/EEC european directive of 12 June 1989 regarding introduction of measures to encourage improvements in the safety and health of workers at work" ( http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:31989L0391:EN:HTML ) wich each country has transposed into its own national legislation.

This occupational risq assessment concept is the same as existing in any occupational safety & health management system volontary standard as your US one for example (ANSI/AIHA Z10).

Best regards.
