How to identify the Management Representative

5.5.2 Management Representative

"Top management shall appoint a member of the organization?s management who, irrespective of other responsibilities, shall have responsibility and authority that includes ....."

Questions:

1) Does a company have to identify who the Management Representative (MR) is, have it documented to make it official?
2) How does a company identify document the MR? The popular ways are
a) In the Quality Manual
b) In the organization chart

I audited a company. The Quality manual section 5 does not identify who the MR is. The organization chart has a block "QMR" with a line connecting it to Top Management. There is no indication who the "Quality Management Rep." is in the org. chart.

Is this a nonconformance?

It may not be.

Ask around to see if top managers know who the MR is and what his or her authorities and responsibilities are. And agree any evidence of the consequences of any system failure.

You may then have evidence of a nonconformity supported by the requirements of clause 4.2.1d

"Failure to document the authorities and responsibilities of the management rep sufficient for effective planning, operation and control of the management system."

Include specific evidence of the consequences of this system failure and cite 5.5.2 in the nonconformity statement though.

Of course, as auditor, you should not report your personal preferences as nonconformities or even as "observations".

The MR can be appointed in any way good for the internal communication of the company. It could even be in the management review record, A letter issued, An e-mail to the person.
If all the other personnel identify the same gentleman as the MR then it is communicated well.

Did you ask his/her name when you audited the activity of Top mgmt. in mgmt. review? Did you check if there is a letter o a formal email where the Top mgmt. communicates the name and his/her responsibility?
Did you meet him/her during your audit?
I think you should provide other info in this thread to understand if there is a non conformity in this sense.

There is no requirement in ISO 9001:2008 to document or record the name of the QMR.
Is it a good idea? It certainly is.
Is it a NC for not doing it? You would be hard-pressed to prove that based on the requirements of the standard. The company's own internal requirements are another matter, though.

Where do you believe the Non-Conformance to be?

Follow the line on the org chart to whomever "top managemnt" is. Ask that person who the MR is and what his/her responsibilities are.

If you "audited a company" you should have conducted some form of opening meeting. That would be the time and place to identify the MR.
