Incoming insepction needs repair - sell as "new", "brand new", or something else

Situation: At the time of incoming inspection, the dealer staff finds a defect in the product and performs parts replacement or adjustment according to repair manual made by manufacturer.
Is there something described in EU regulation how this dealer should sell this product, "new" / “brand new” / or something else.

Why did the dealer replace the defective item instead of the manufacturer?

Take another look at the contract the dealer has with the manufacturer to replace the defective item.

To my knowledge EU regs have nothing to do with this situation.

Without knowing the type of equipment, how can one determine if there are regulatory requirements involved? Is this a medical device? An automobile? An aircraft?
