Advice Needed on AS9100 Certification Clause Exclusions

Hello Everyone,
I’m seeking your advice.
I'm currently working on an AS9100 certification project for an aircraft manufacturing startup. The company is planning to go for an initial certfiaction with the scope of design and development of light aircraft as the current state of the product is in the design phase. They plan to manufacture and test their first aircraft in 2026.
During the initial audit, would it be possible for the company to exclude the following clauses?
  • Clause 8.5: Production and Service Provision
  • Clause 8.6: Release of Products and Services
  • Clause 8.7: Control of Nonconforming Outputs
Also is there any other clause they can claim extension

Just a reminder, there are no more "exclusions" in the standard, there are only clauses that can be described as not applicable.

Clause 8.5: Design is the service, no?
Clause 8.6: The organization will control the release of the design, no?
Clause 8.7: The design may possibly non conform, right?

I don't think these clauses can be declared not applicable to an organization. Perhaps you could post the proposed scope of the organization? It may offer more insignt.

thanks, The intended Scope of certification is: Design and development of "xxxx" aircraft;

To add some context: The company plans to manufacture the aircraft in 2026, and during that time plans to extend the scope to add manufacturing

Clause 8.5: Design is the service, no? : I am not sure, design itself is managed as per clause 8.3
Clause 8.6: The organization will control the release of the design, no? managed as part of 8.3.5
Clause 8.7: The design may possibly non conform, right? : Is it not accepted to say that we manage design non conformance based on 8.3.6 (Managed through configuration management)

No, absolutely not. Assuming you are working with a reputable CB.

Clause 8.5. Once the design is complete, it becomes the "product" (your design process must address requirements of 8.3 AND 8.5)
Clause 8.6: Once the "product" is complete, it must be assessed against requirements prior to release (yes, it could be part of your design process, but then the design process must address requirements of 8.3.5 AND 8.6)
Clause 8.7: 8.3.6 does not address taking actions to correct the system as to why it allowed a 'bad configuration' to pass muster. Also, there are other outputs of your system that could be non-conforming, like a bad quote. Also, if there is no plan to meet the 8.7 requirements, how would the organization manage a non-conformance in the Internal Audit, or Management Review, or Quote Review?

Why worry about the whole thing, just build it and fly it? Whoever wants to "exclude" takes the 1st ride.
