Applicable Legal Requirements - What about exceptions?

Hi,

I have been following the forum for quite some time and has learned A LOT already.
I can find almost any answer that I am looking for!
So this is my first real post, and I am looking forward to all your valued input.

Currently in the process of doing a GAP for ISO14001, I am looking into the legal environmental requirements.
On some of the "standard" environmental requirements in the UAE, our company is getting an "exception", indefinite or temporarily.
Like normally we should have own waste water treatment, but they allow us to have it hauled and treated by a (certified) third party.
So we are currently not following the "standard" applicable rules.
Will an auditor accept these exceptions? Or would that be against the basics of ISO14001?

One is the law (environmental) of the land, the other (ISO14001) is a voluntary standard - the law takes precedence. Provided you have black and white approval for the exemption (not a new thing - practice here also).

The standard (14001) only requires compliance with applicable legal & other requirements. So the exemptions granted to you by the regulatory authorities are as good as the requirements themselves. No regulatory authority can grant an exemption unless it is authorized by a higher authority to do so.

However the auditor can still make an issue if the offsite disposal of wastes/ waste water does violate any of your policy commitments/ objectives /corporate commitments to interested parties etc. etc. e.g., commitment to comply with the provisions of Basel Convention (disposal of waste as close as possible to the point of origin), GHG emission reduction (transport of waste may generate additional GHG emissions & other sort of pollutants) etc. In view of this, you may revisit the policy and other documents to (re)verify the compliance of 'other' requirements / commitments, if any.
