California Prop 65 Applicability

Hello Everyone,

Can any one provide the details regarding the applicability of California Prop 65 that is it applicable to all the electronics devices going to be sold in the California for personal, professional or commercial use?

Also one more thing that there any other material restrictions or regulations to consider before proceeding for the selling of electronics devices in the USA & other American countries?

I have searched for it a lot but the thing is there is only mention of the electronics products for personal or professional use but there are not any specific categories mentioned. That's why I was wondering that this regulation is applicable to all the device or not.

Prop-65 applies to everything sold in California. It is all about if your product contains a substance of very high concern. Then appropriately communicating that to the consumer as close to the pint of purchase and/or use as possible. Some substances require labeling no matter the quality. Lead is an example. other substances the need for labeling is based on the amount as a percentage of the product weight.

Prop-65 is one of these laws that had good intentions, but has essentially become a vehicle for troll laywers to sue companies. Then compliance firms try to scare you into paying advising and testing fees for them to help you avoid lawsuits.

Why are you concerned with Prop-65?

I am concerned about it because we are a third party product design & certification service provider. So if our customers are targeting to sell their products in the USA then it would be essential to be aware about the Prop 65 requirements to prevent the non-compliance with the applicable requirements.

Just tell them not to sell in California and there should be no problem with Prop 65.

I am not a lawyer, but I would think that your customer would be liable for ensuring the product is compliant with California's Prop 65 requirements. Your company would need to support them by providing details on what chemicals on the Prop-65 list are present in the product and if they exceed the limits.
