Can a faulty new equipment be repaired and sold as new?

So I found the Ts & Cs from a medical device company on the web that kinda fits what we're talking about here:

6.2 Out of Box Failure: For Product experiencing failure within the first ninety (90) days of original shipment, Buyer will contact Inogen to obtain an RMA number. Inogen will ship a replacement Product (which solely at Inogen?s discretion will be a new Product or a repaired Product built to a new specification and warranted as new) to Buyer in advance of receiving the failed Product. Inogen will cover the shipping cost of the replacement Product to the Buyer as well as return shipment of the failed Product to Inogen. Buyer will not be charged for the replacement Product provided Buyer returns the failed Product to Inogen within ten (10) business days. If failed Product is not received within ten (10) business days from issuance of the RMA, Inogen will invoice Buyer for list price of the replacement Product due and payable by Customer upon receipt. If product is deemed damaged as a result of user abuse and is therefore billable to Buyer as a Product repair. Buyer agrees to accept repair charges in this event and will be invoiced for said charges, due upon receipt.

So if Inogen sends them a "repaired product...warranted as new", is it labeled differently, or does this T&C doc cover everything?

I cannot say for sure what Inogen does...but my organization - which also provides refurbished equipment as replacements for new - clearly labels this equipment as refurbished. we do NOT label it as "New" even though we warranty it with the same terms as our New equipment...we do this even in Europe, Asia, South America...

I think it's clear from the provided text that Imogen also does not treat refurbished units as new, even though they provide the same warranty.
