Can a Mil-Spec Fastener be sold as such with no certification or documentation?

Theoretical question. If a vendor is AS9120 or AS9100, could a rogue fastener actually be sold as a "NASXXXX", even with the caveat that it comes with no certification?

8.1.4 is fairly open ended on what "appropriate to the organization and the product" means, but if there simply is no documentation that the product is what they say it is (or fulfilling any of the hundred standards within the spec)... is there a possible "appropriate" control process that could compensate?

Why would one want to do that other than trying to possibly commit a fraud? Besides the fasteners aren't certified for crap, it's the management system of the organization making them that's certified.

I've seen it with distributors (certified to AS9100) that they sell mil spec fasteners and specifically state that no mfg certs or test reports are available. It's in that case I'm wondering if they even have a right to label their product as a mil spec fastener.

That's more of a legal advertising question, if they chose they could say cherry flavored until challenged to prove it.

The burden falls on you to be able to prove that your fasteners meet the mil spec if that is a contract requirement.

If you are AS9100 Certified and selling something to a spec. you better be able to produce a cert for it when asked.

Wait, I just reread the question and YES, IT CAN BE SOLD AS SUCH, it can also be sold as a cure for cancer or hemorrhoids as well.

Would the sale and claim be valid is the real question and would be best answered by the herd of lawyers lining up outside the door of whomever sold the stuff.
