Does the Client need to disclose everything to the CB auditors in relation with any Quality non conformance problem prior to the audit. When you may have a breach of contract?

From personal experience:

- If you are already registered and are talking about switching registrars, then the registrar will need to see a copy of your current certificate and a copy of the last audit report. They will also ask for copied of your responses to any findings from the last audit. The registrar is supposed to communicate to the auditor the details of the transition audit. You do not have to disclose anything to the auditor in particular unless you want to be kind when they are asking for information as part of the audit preparation. The 'kind' option will just make their and your life easier during the audit since it cuts some of the information finding time.

- If you are talking about an audit with a new auditor, the auditor should already have copies of the findings and resolutions from the registrar's records. You can be kind/nice and disclose the details to them upon request, or you can just tell them to contact the registrar for the formal responses to any previous findings.

- If you are talking about findings from a previous audit where the registrar asked for a formal response (i.e. 'major' findings) then it is not uncommon for the registrar of the auditor to ask for supporting evidence that you have taken the actions that you porposed. However, this is/should be done prior to the registrar closing the findings and scheduling the next audit. In this case you are required to disclose and provide evidence of your corrective actions. Sometimes an audit will be scheduled even if the findings are not formally closed but only if the auditor needs to verify in person that the actions have been implemented. The auditor will still need to see your action plan and some evidence of implementation before risking to waste your and their time adn resources on a trip for nothing.

Can you give us a bit more information? As a CB rep. I can tell you what the expectations are (from my company, leastways) but we don't have much to go on! If you are changing (or evaluating) another CB relationship, the advice given is correct. If you are merely asking about problems prior to the next CB visit, then if you don't disclose the issue, you are likely to affect the credibility of your registration. But, tell us more, before we jump to conclusions.

:read: You have a breach of contract whenever you are not satisfying the terms of a contract. So, if your contract says that you have to disclose certain information (when, where, how and to whom), then you have to do it. Else there is no breach.

Like Andy suggested, more details will trigger a more accurate answer. :agree1:

This was for a AS9100 re-certification audit.

Don't every CB has something like "accuracy of information" on their contract meaning that the client need to disclose for example the problems with the Fed's I am not talkinkg propietary data or on the basis of legal previlege.
Can you get recertify if you don't disclose that to your CB?
And when is not a compliance audit? if the CB finds that you are not in compliance with the regulations requirement.

What can be wrong with ANAB?
They conducted the surveillance audit together with the CB and the allegation for the complaint were confirmed on early February 2010.
The complaint is still pending.ANAB complaint # 334.
Don't they suppose to reach a conclusion by now?

You are mentioning about a complaint to ANAB.If it is related to your CB and AS9100,you may use the feed back path in OASIS.Just try.
