The difference here is what you are being asked to do. If a contractor is asked to do the design, then yes, the contractor is design responsible. If the contractor is provided the design and told to build to the design, then the contractor is not responsible.
Agree :truce:

If, no independent design is taking place at the contractor's and all dimensions/characteristics are defined by the customer, with the contractor being responsible for production only. :agree:

:truce: I just realized that my comments may have come across a bit strong when I was just trying to clarify.

Guess I still haven't learned the art of speaking with finesse. :vfunny:

Revised 7.3

:truce: We all have different experience. Mine's rather limited, thus the excessive questions. :lick:

Here is what I've trimmed down 7.3 to:

This portion of the ISO 9001:2000 standard does not apply to Van Dyke Industries. VDI is not currently designing its own products. Therefore this portion has been excluded.

All current truck (and automotive) product designs are customer owned and controlled. Vent assemblies and components distributed by VDI are based on older customer or public designs. Production Part Approval Process (P.P.A.P) submissions are made as required. Product approval and validation is the responsibility of our customers. New products are planned for and conformity is verified as required by customer directed and/or internal quality plans. Addition testing and final product certification is performed and obtained by our customers and is not the responsibility of VDI.

Production of additional new products and revisions to other miscellaneous products shall be directed and approved by our customers. Product introduction and process changes directed by our customers or required internally to meet customer and product requirement are managed within our Engineering Change Control procedure.

I realize I'll probably have some explaining to do to justify my justification, but I think I can live with that.

And from my point of view:

"If the contractor is provided the design and told to build to the design, then the contractor is not responsible".

Is the situation we're currently/typically in.

With my situation clarified, how does my 7.3 exclusion/justifaction look now?

Perhaps to help eliminate some of the "justifying" of your justification you could say:

Our customer's are responsible for providing the design documentation and the performance of design reviews, design verification, design validation and change control for any new products and revisions to other miscellaneous products.

Just a suggestion.

WOW that sounds great.
Thanks for the suggestions! :bigwave:
