Design or not design that is my question

ok folks I know I don't show up as often as I should, but a change in jobs took me out of the loop. here is my question.

I have a company that has excluded design authority from thier manual, howwever there came up an issue where a customer does not have a drawing just specifications and they want to use a 3rd party engineer with the customer approving the design prior to manufacture . Does this mean I have to put some sort of design control in the manual.

Who wants to use a third-party engineer? Your company? In other words, your company was given some specifications and has chosen to have a third party create a drawing from them? If that's the case, you (your company) hasn't actually designed anything; it's no different from receiving a drawing from a customer and creating your own internal drawing for manufacturing purposes. At least that's what I'm guessing from the information provided.

On the other hand, if by "specifications" you mean that a customer has given you some vague idea of what the thing is supposed to do, and you or the engineer actually has to design something novel as a result, the answer could be different.

it is more the first reply , however if something goes wrong with the designed item outside what the customer asked for and they want it changed who would be responsible for tracking these changes.. Customer/Engineer/Me

That should be a matter of contractual agreement between your company and the customer.

The requirements of 7.4 will apply, if the customer wants your company to deal with the 3rd party.

Also, you should look at the outsourcing guidance document from TC 176 (http://isotc.iso.org/livelink/livelink/3553354/Outsourced.doc?func=doc.Fetch&nodeid=3553354) and probably have some requriements in your contract that cover 7.3 of the standard.
