Do I need to use an EASA Part 21 approval, to upload software on a Transport Category

We're preparing an airplane to be leased, the airline consulting for my client, is insisting in that the previous operator, should have used their EASA Part 21, DOA, to write an EO, for the installation of new/updated software into the airplane's AMC

EASA = European Aviation Safety Agency (European equivalent to FAA in US)
DOA = Design Organisation Approval (Part 21 Subpart J approval holder in EASA system)
EO = Engineering Order
AMC = Aircraft Management Computer (generic term for a number of control systems in the aircraft such as Flight Management Computer)

What the adviser is asking is if you had a DOA approval for a software upgrade. If the upgrade was approved for upload (released by the OEM or aircraft TC holder) then any 145 (maintenance) or even the maintenance entity supporting the 121 or 119 operator could have done the upgrade. I would assume the software upgrade came with an EASA Form 1 or be an approved modification released through some other approved method. I would be surprised if it was an EO, these are normally internal documents not utilised between the DOA and the maintenance org or operator. I hope this helps.
