Do we need to treat local law as external origin documents?

Hi Rajan.

Are these local law directly about the product / service that your QMS is connected with, OR you are referring about the other local laws of the land governing establishment license, registration, clearances, taxes, consents and such other.

If within the scope of your system then yes.

Such documented information needs to be monitored for changes ready for timely updates to your organization’s management system.

You may be able to subscribe to a service that notifies you (or the relevant process owners) of upcoming changes.

Somashekar, if laws refer to land, registration, taxes, security of buildings, do also need control as external documents? Even if they are not related to the product?

Is a doubt I have had, if we check the standard:
1 Scope
This International Standard specifies requirements for a quality management system when an
organization:
a) needs to demonstrate its ability to consistently provide products and services that meet customer
and applicable statutory and regulatory requirements, and
b) aims to enhance customer satisfaction through the effective application of the system, including
processes for improvement of the system and the assurance of conformity to customer and
applicable statutory and regulatory requirements.


According the standard, it seems it refers only to product, but in regulatory requirements
don´t you think an organization also have to consider these issues?
What happens if we don´t comply with local goverment regulations, land, taxes, anti fire systems?
Could you clarify this point?

Your management system must deploy the regulations that are within its scope.

It can ignore laws and regs that are outside its scope.

Please bear in mind that quality (and security, sustainability etc) is delivered by the organization’s business management system.

I agree with John. Treat them as external origin documents. If you have an internal set of requirement that comprehensively covers the external (local law) , you can use your internal requirement on its own (just reference the local law in the "purpose section" and define a procedure for updating your internal requirement if the law changes).

What happens if we don´t comply with local goverment regulations, land, taxes, anti fire systems?
Assuming the business gets caught in instances of non-compliance, they are normally financially fined. And, if they are repeat offenders, the punishment might include revocation of the permits, incarceration of responsible personnel, etc...In some cases, the legal proceedings can take years and in some countries, inspectors can be bribed....

Any business needs to be aware of the regulations they are exposed to, but it would be very unwise to infer/expect/assume that a quality management system should be involved with the collection, control and dissemination of such documents. Unless of course, your business is a consulting organization or law firm involved with regulatory compliance.
