IATF 16949 Cl. 8.4.2.2 vs 8.6.5 - Is there any difference between these clauses?

Dear friends,

I have read the clause 8.4.2.2 and 8.6.5 many times, and actually I could not see any difference in their underlying content, both require to ensure that purchased/externally provided products or process conform to statutory and regulatory requirements of different countries.

Do you see any difference?

Also I didn't see a relevant difference among both clauses !
Just if for the clause 8.6.5 is expected that the organization defines a method to check the compliance of the purchased products against the statuory and regulatory requirements. (For exemple during PPAP phase check IMDS, reach and conflict minerals compliance).
For the clause 8.4.2.2 is more complicated to understand the applicability of the requirement. Seems to be the same.

8.4.2.2:
This clause speaks about defining the process (Procedure) about how you'll ensure that applicable statutory and regulatory requirements are met by external providers.

Planning phase.

Documented procedure is required.

8.6.5:

This clause speaks about actual implementation. Ensuring that applicable requirements are met by external providers as defined in the process (Procedure) as per requirement of 8.4.2.2.

Records are required, as specified in the procedure.

Do phase.

Hello, Can someone comment on which statutory / regulatory requirements are in the scope of these clauses? I saw a couple examples above, but are there others about which we should be concerned? How would one go about determining the regulatory requirements of a particular country? To what level / scope is expected?

Good morning my fellow Elsmar friends!

I've got a question....
Can someone explain the difference in clause 8.4.2.2 "Statutory and Regulatory Requirements" and clause 8.6.5 "Statutory and Regulatory Conformity"? Seems redundant.

8.4.2.2 requires you to have a documented process to ensure that purchased products meet the legal requirements.

8.6.5 requires you to have evidence that all products that you ship meet the legal requirements.

completly agree with this explanation.

We just had a transition audit and it's was also explained like this by auditor.

In IATF you must have a process, procedure showing how you work and process all above requirements for example :
Customer sends RFQ-> Sales dept. is processing it togheter with R&D-> They need to check which legal requirements should be included-> Then they should transfer it to Purchasing so they can apply it in supplier chain-> Suppliers need to confirm within quotation phase.

You need to describe it, make a flow chart, assign responsibilities etc.

It can be connected with IMDS, REACH, Special methods and standards used in different countries for example flammability requirements etc.

In big organizations usually Legal department should be involved.
