Gentleman,
In the case that a person becames an informant to the Fed's in a series of violations commited by your company, how that person will be protected?
It will be a matter of time until your company find out, or you can be protected by the law?
I read Wes post and he mentions that you need an attorney to handle this issues. Also, is the 10 % of the fines that the Fed's penalize your company applies to the informant ?

:thanx:

Re: Fed's Regulations Violations.

Never base actions with potentially significant legal consequences on advice you get from an online forum.

Especially when it's not populated by lawyers in the first place.

Some of us may have a degree of knowledge of regulatory law...but your question isn't even substantially about our area of group expertise.

If you've got a legal question, and you care what the outcome will be, you need legal advice. Consult a lawyer.

Re: Fed's Regulations Violations.

Consult a lawyer that knows what he's talking about. In cases like this most lawyers are dumber than a rock.

I've personnaly seen "witness protection" in action and know folks that went to "Stoolies-R-Us" or "Squealers Anonymous" and it ain't like TV or the movies.

Oh yeah, unless the "principle" is "as clean as the driven snow" immunity may be iffy at best and the employer will do their best to prove culpability on the part of the snitch.

Yep good lawyer plus follow ALL the guidelines in the "ethics" thread AND be prepared to wait YEARS for resolution, during which time you may be blackballed from ANY work if the employer even suspects you are the instigator.

This thread has been nagging at me since I first read it.

Folks read the story about the substandard conditions at a peanut plant causing dozens or hundreds of illnesses and they rise up in righteous indignation because somebody didn't report them.

If you suddenly have a shot of courage about reporting practices at your own workplace, I strongly urge you take the time to read through
Ethics - Moral law vs. Criminal law
before you pick up the phone to call the feds or other regulatory body. Take a LOT of care in selecting a lawyer to help you through such action. Once you become even a "suspect" whistle blower, your life will change drastically - most often NOT for the better. Do not get any crazy ideas of "going public" and making the rounds of media like now ex-Governor Blago - it's more likely you'll be viewed as a freak, not a serious person.

There are multiple ways to "drop a dime" on an unacceptable situation without letting your name be known.

My perception is that often a person wanting to be a public whistleblower is motivated to some extent by a desire for public huzzahs and/or rewards. That's a really problematic approach in the real world, as noted in this thread.

If you know of a problem with potential importance to the public, go to the public library and send an anonymous email from one of their computers, using a freshly-set-up, one-time webmail account if need be, to investigative reporters at several big-city newspapers and to the appropriate regulatory agency. Or, mail an anonymous computer-printed letter to multiple relevant recipients, annotated so that they each know the entire recipient list, from a large city other than where you live.

Whatever you do, though, don't let your ego get the best of you and include some sort of identification, return-contact address or personally identifiable information in the communication. Stick to a very general description of the problem. Let the investigators figure out the details.

The thing that most bothers me about this post is the part about the informant getting 10% of the fines. It seems to me if you are going to report a violation, you should be doing it because of the violation and not because you hope to gain financially. That being said, follow Wes's advice and hire a lawyer.

Yes, Steel. 10% of a million dollars is not much compared to a ruined life.
