Our company mines and processes an ore used as a filler and binder for various paints(some used in the auto industry), plastics, ceramics, steel ect... This product can be treated or untreated depending on the customer's need.
This statement worries me. First, taking exclusion is not an "all or nothing" proposition. You can take exclusion to part of a clause. The question in my mind is “does your customer specify the treatment, or does your organization suggest a treatment based upon application?” If the latter, then you may not be able to exclude all of 7.3.
I had the same situation with a distributor of water treatment chemicals. They took exception to 7.3 because they distributed off the shelf chemicals. However, they then took those chemicals and either suggested a combination or combined them and repackaged them based upon the intended use. At that point, while they could consider some of 7.3, they could not exclude ALL of 7.3.
