I'd still suggest you check your agreement small print. Then you should take it up with the CB's management. Please don't roll over on something with which you disagree. He will be allowed to wander off, doing the same thing to others in industry making busy work for those who already are stretched thinly. Make your concerns known. If necessary, change your CB. It might be cheaper than wasting your time here and with your current CB debating the point.

It was the fact that we have controls in place that were not identified on the control plan. He found one per CP.

"The customer is not at risk in any way" was the first words blurted from my mouth when I was informed of the Major Nonconformance at the end of the day. He read to me from his manual - "A number of minor nonconformities against one requirement..." is a Major.

I will certainly include it in my appeal but I was searching for additional strategic points.

Any auditor who thinks and acts like that needs to be re-acquainted with the correct way to perform audits. I can't think of anything more "strategic" than putting your CB on notice of their poor auditor performance, their review of your supporting facts, the removal (or downgrading to minor) of the findings and potential transfer of your certificate...

Thaks everyone for their comments regarding the concern I posted.

We provided a successful appeal and the Major Nonconformance was reduced to a Minor Nonconformance. As suggested by someone in this post and written in our appeal, the issue was considered one Minor Nonconformance with two supporting examples.
