The release of the 9001:2008 standard reflects a point of clarity regarding this issue. Simply stated it says the Management Representative must be a part of management of the organization. This emphasis is on the need of the management representative be internal to the organization with the responsibilities and authority to drive priorities, resources, etc. Furthermore you cannot exclude this requirement from your management system.

If the management can say that Mr. X is the MR and give him the authority and responsibility to perform what a MR needs to perform and is competent based on which the management trusts the person and appoints / contracts, he is in fact taken to be a part of the management of the organization, (or internal to the organization as said by Ltibert).
appoint a member of the organization's management by this as in 5.5.2 it is NOT meant that he must be a share holder of the company, permanent employee of the company, must work for 8hrs a day in the organization, should have a managerial designation,
