I think only Jane B summed it up correctly.The spec does not say "Top Management" so the IT manager,the admin Manager are all part of " Management". They dont make the decisions, they see that "Top Management's" decisions are carried out, in the case of the M/R if he/she is part of Man but not Top,if production dont do CAR's, they dont have to complain to T/M, but make out a NCR against the system. Then the 2nd and 3rd party auditors will address the issue with T/M. Objective proof of this is clause 5.5.2 (b)

You would write up the situation I described, where the CEO has explicitly stated that Sally is a member of management, and all of the responsibilities of the MR had been satisfied? On what grounds?

Understand that part of my hypothetical was that all of the responsibilities that come with being MR had been met. Why couldn't Sally (irrespective of other responsibilities, as the standard says) interact with external parties and be present during the audit?

Jason, the M/R must be shown in the organogram, and this person must be formally appointed by the board/top management. The auditor found it written somewhere/or that the management rep was part of management.But the inconsistency must be that he/she was not formally appointed as such, for QMS purposes that is. The M/R will not sit at board meetings,but will sit at review meetings.

Where is this written? What constitutes "formal" appointment in normative terms?

The MR will "sit" wherever top management wants her to sit, including board meetings if that's what top management wants. On the other hand, if there are management review meetings (which are also not required by the standard) there is no requirement for the MR to attend them.
