Thank you very much KGott, we have a Health and Safety Representative who is also the process team lead. I have discussed this with the MR and his assistant and will be involving the HSE Officer.

Thanks - asked MR for the audit report, accident form referred to and copy of OHSAS implementation plan designating roles. He sent me incident management process and extract from audit report which says non-conformity related to 4.4.3.2 - workers participation in accident investigation. Asked for accident form again, and any internal audit report. He now replied what is my role in incident investigation? and perhaps he needs to look at assigning the CPAR to HSE Officer.

Process map which he created and he is process owner of says work supervisor and subject matter expert will investigate/communicate regarding incidents.

I suggested if OHSAS standard requires, perhaps alter the process to explicitly state that worker participation will be ensured by the supervisor. Thanks for making it clearer that it makes more sense for workers in the immediate work environment to be involved, because he did remark that auditor may ask why workers from other functions or divisions are not involved for their participation. I have also suggested worker participation by way of incident committee, bulletin board, newsletter. Waiting for a response.

Thanks TPMB4, you have picked up a pertinent point. I found out that HSE Officer is cousin of the Managing Director/Company Head. HSE Officer's Manager is another cousin of the MD. Process owner MR / Quality Director is a close friend of MD. It appears that a NCR if assigned to HSE Officer in such closely related circles is looked upon as an affront to personal relationships. I am not a cousin or a crony, and easy to pass this NCR to.

Thanks to ISO and OHSAS standards because the process is clear or if not, then needs to be defined clearly. Otherwise, as said previously in this forum, it is only an opinion.

Now it appears that this was an effort on the part of MR to pass on the buck because of all the relationships involved. MR is not my boss, but is a crony of the MD who is my boss. You mention to flow it back through the system, how is this done, I will appreciate your advice. Thanks again.

I liked your recommendation very much of management review agenda, thank you and will raise it to MR. Currently, based on expert recommendations on this post, I suggested to MR that if OHSAS standards require, then to review the process to explicitly state worker participation and designate responsibility. Current process states incident will be handled and investigated by supervisor and subject matter expert.
