Our quality system is in compliance with ISO TS 16949 but we are only ISO 9001 certificated.
If in internal Audit we have a non conformity on maintenance we should address it to process 6.3 or 7.5 (7.5.1.4/5)?

Refer to 7.5.1 c). However, if you have requirements (procedures, instructions, schedules, etc.) for maintenance, you should cite those when writing a nonconformity report.

If you read the standard closely (ISO 9001:2000 and 2008), there is technically no requirement for PREVENTIVE maintenance. Although there is a requirement to MAINTAIN the infrastructure, and of course preventive maintenance is generally a great idea, the standard does not require "preventive maintenance." (Some organizations, like service organizations, might have nothing to maintain "preventively" so the standard can't require it of everyone.)

Any records of maintenance generally suffice to demonstrate maintenance was performed as required of the standard. However, if your system calls for preventive maintenance, as it should if you have any kind of production operations, the auditor is correct in assessing whether you comply with your own requirements for preventive maintenance. If you do not maintain the infrastructure according to your own requirements, the auditor will rightfully raise a nonconformity.

Just to add fuel to the fire. According to TC 176, there is no requirement to keep maintenance records. See for yourself:

In our end, as TS16949 Certified Company, we are required to follow the requirement of Clause 7.5.1.4 Preventive and Predictive Maintenance.

Sure - but that's per the other standard you quote (TS16949) and not ISO 9001.

If you are claiming compliance to TS, then I would say that the TS requirement is the better fit, because there is no "shall" associated with preventive maintenance in ISO 9001. However, as already stated, you sould cite your local level documentation, since that is where the specific requriements for maintenance will probably be found.

Correct, there is no requirement for records in 6.3. But that doesn't mean that records of maintenance are not required. Record requirements reside in 4.2.4. If an organization has requirements to perform maintenance, 4.2.4 requires records are maintained to demonstrate conformity to these maintenance requirements. If an organization has no requirements for maintenance, then records are not required.

I disagree. While it is a good practice to establish records for maintenance activities, it is not required. Other than the 4.2.4 references in the Standard, any additional records to be established are an organization's decision.

ISO 9001:2008, 4.2.4 states, "Records established to provide evidence of conformity to requirements . . . shall be controlled." Conformity to requirements is not limited to requirements of the standard, but includes management's own requirements. However, if management has established requirements for maintenance, it is possible that no records of maintenance were established. (In some cases, it might be obvious that maintenance was performed, thus no records are required.) In this case, maintenance records are not required of the standard. Certainly in most cases, if maintenance is required, some record of maintenance is generated. If management needs these records to ensure maintenance is being performed as required, these records have been established as records to provide evidence of conformity to requirements and the standard requires them to be controlled accordingly.
