Qualifcations of Staffing Agency Employees to meet job description

I am having an interesting conversation with our HR department regarding requirements of staffing through a temp agency.
The IATF 16949 standard mentions contract employees in 7.2.2

7.2.2 Competence – on-the-job-training

The organization shall provide on-the-job training (which shall include customer requirements training) for personnel in any new or modified responsibilities affection conformity to quality requirements, internal requirements, regulatory or legislative requirements; this shall include contract or agency personnel. The level of detail required for on-the-job training shall be commensurate with the level of education the personnel possess and the complexity of the task(s) they are required to perform for their daily work. Persons whose work can affect quality shall be informed about the consequences of nonconformity to customer requirements.

Would contract employees be required to meet the qualifications from the job description such as: education, skills and health and safety requirements (lifting, force, standing exc)? They currently only have employees that are going to be admitted into the union undergo a physical where lifting, bending exc is challenged.

Yes, no matter the contractual relationship the people doing the work that affects the quality of the product shall be competent.

You may have to extend this requirement to include HR personnel!

Speaking solely as the customer (outside of TS16949 requirements)...
"If they are going to touch my stuff, they better know what they're doing"

If the temp folks doing the work don't have to meet the requirements, why does anyone? If they do, then everyone does.
Temp workers vs. employees is a financial arrangement...the work is the work. Get the work done right, the rest is paperwork, lawyers and accountants.

Thank you for your quick responses and to validate my thought process.

I told them that in addition to the IATF requirements they should follow the same requirements for safety (50 lb lifting, 30 lb force etc) for the safety of the employee (or their minds- the risk of a lawsuit because of injury).

Just a heads-up that even if the temp/contract member is competent because the agency/contractor says the individual meets your requirements, this does not necessarily absolve your organization from all responsibility.

From my own experience, a contractor experienced a serious injury while working on our site - a fall from a height. We had the tie-off points that met code. The individual had the right paperwork. The contractor agency had all of it. The individual arrived in the morning with alcohol in his system. We did not practice checking workers for alcohol although I believe our contract did address working with alcohol or other substances. Long story short - the organization, not the contractor or the individual, was found to be primarily at fault.

I realize that this is a safety example, and not one of quality necessarily, but just pointing out that your own organization is not 100% free-from-blame something is found to be at fault with the competency of temp workers or contractors, regardless of what your contract may say.

We have a brief 15 minute orientation with a temp before they hit the production floor. We have a simple form that they sign / date as well as the person doing the orientation. Format is as follows:

The person listed above has completed new hire orientation for a Temporary Employee at XXXXX. The training consists of:

What we do at XXXX
An overview of our Quality System
Health and Safety rules, issues and requirements
Any other information applicable to the job they will be performing

We then start a training record with a checklist that gets updated. After a 2 week period, the following section is signed off:

Sign and date when completed:

______________________________ Employee’s name ______________ Date

______________________________ Mentor’s name ______________ Date

Based on a 2 week audit check, the employee listed been above has been trained in the basic requirements of being an operator at XXX and is competent to perform all associated tasks. Additional on job training will be provided as required.


______________________________ Shift Leader or Trainer (after 2 week audit) _______________ Date

Thank you for that information. Our temps also go through our new hire orientation with safety, quality and environmental. They are required to read and understand job instructions. I am more worried that they do not go through a physical like our employees do. These employees do not demonstrate the ability to lift/push/pull like the job description states
