A friend of mine has been contemplating leaving work. Now's a good reason to do so since being off work due to doctors note and required physical therapy.
Is submitting a letter of resignation and calling it quits have any consequences from the employer? :read:
Any experiences, law restrictions, advice, or links to websites ?

Was this caused by an on-the-job injury or personal?

In the USA it is illegal to terminate someone that is injured on-the-job or other if under Doctor's care. There is a possibility that if there is modified duty available that the Doctor agrees with and the employee refuses, that could be cause to be terminated.

My best advice (to your friend) is to consult an attorney and see the legal aspects and how they apply to your country.

Depends on whether resigning just from job or from ALL working.

Just from job, no consequences unless there is an employment contract.

I would caution a conversation with an employment lawyer on wording and extracting GOOD references if the person expects to work elsewhere.

From all work - absolutely no consequences (except for income to keep living and support self and family)

Coury, this was an injury outside work and may be a good time to submit the letter.

Just from job, no consequences unless there is an employment contract.

I would caution a conversation with an employment lawyer on wording and extracting GOOD references if the person expects to work elsewhere.

From all work - absolutely no consequences (except for income to keep living and support self and family)
Wes, I mentioned to not burn any bridges and submit the letter in person to maintain that relationship and for future reference needs. No breach of contract here.

My point was missed. It is ALWAYS better to get the good referral letter at the time of leaving. Subsequent events may cause the company to change policy on referral or the folks who would have given glowing referrals are "gone" and not able to deliver on a verbal promise.

I'd elaborate, but suffice to say many executives think, "Tell him anything he wants to hear just to get him out the door with no big stink!"

One of things I've noticed in the uk with regard to references is that many employers will only confirm that the person worked for the company between the stated dates and as a matter of company policy will refuse to comment on the competency and performance of the person in their job role.

From what I have read here can I assume that American employers will still comment on the competency and performance of their ex-employees in references?

no. the new philosophy is that you confirm they worked for you. that way you don't incur any lawsuits from any direction. sad, isn't it that we've become so afraid of being sued we cannot give a good recommendation? Get it in writing on letterhead before you walk out the door.

There are ways to get around commenting on a person's competence.
One method is they will ask "Would you re-hire this person"?
A simple yes or no tells all they need to know.

Most people quit bosses, not companies.

So, why worry about corporate references? Refer to the co-workers who will speak positively about you.

I'm sure you wouldn't really give that advice to a son or daughter, setting the kid up for a blindside attack at some point in the future when a really important job or promotion is on the line and the researchers are going all out to discover something, anything, to torpedo a candidate.

If you can, get the referral letter now. You won't have to worry about anything in the future as more and more companies are loath to give out any info (good or bad) beyond confirming you actually worked there. An employer is more likely to believe a signed letter in hand than a phone conversation with a clerk who can't even describe what you looked like.
