Hello Cove! This is not a hypothetical; it involves a colleague. Identities have been changed for confidentiality. XYZ Company is certified ISO 9001:2008 by Certification Body (CB) A. The three-year certificate will expire in January 2018. XYZ wants to transition from CB-A to CB-B (for various reasons) for the next cycle and upgrade from ISO 9001:2008 to ISO 9001:2015. The arrangements with CB-B are complete.

CB-A is inquiring about the coming re-certification audit on their schedule for the fall. Before XYZ responds that they will discontinue using CB-A's services, I have heard anecdotes about CB's that quickly withdraw their certification upon receiving that news.

Does that practice occur? If so, is it legal or ethical? What's the rationale for the practice? On the other hand, stringing CB-A along for months to avoid the cancellation of the certificate is inappropriate, yet XYZ is tempted to do that to avoid premature cancellation of the certificate. What say you, Covers? How should XYZ proceed?

Unfortunately, some CB's used this practice; so much so, that in the US, ANAB has issued an Accreditation Rule PROHIBITING it.

You can read the Accreditation Rule #17, from ANAB. Pay close attention to the paragraphs that read

3. The issuing CB shall cooperate with the accepting CB to facilitate the transfer of a valid certification. Prior to the transfer, the accepting CB shall document a transition plan which shall be communicated to the issuing CB and the client, with due consideration of the audit and certification cycle of the issuing CB so appropriate surveillance for the certification is maintained. The issuing CB shall not punitively suspend or withdraw the client’s certificate on the basis of notification that the client is transferring to the accepting CB. When extenuating circumstances (e.g., nonconformance, lack of payment, failure to schedule required audits, or client request) require suspension or withdrawal, the issuing CB shall follow its suspension or withdrawal process.

3.1. If the issuing CB takes punitive action without cause, the accepting CB and/or transferring client can lodge a complaint with ANAB using the process at www.anab.org.​

So the question now: is CB-A accredited by ANAB? If so, they should be covered. If they're accredited by another Accreditation Body they should do some more homework.

I wonder if they would increase their unannounced audits in order to squeeze the last drop of revenue before you leave...there is nothing that says they can't do that.

We have to keep in mind that the expectations for "unannounced audits" performed by NB's and CB's are different. In the Accredited CB sector, they are actually called "short notice" audits and their performance needs to be justified, i.e., customer complaints, regulatory concerns, QMS breakdown, product failures, etc...

If a CB were to (try to) perform an unannounced audit of a registrant after being advised they were transferring their certificate to another CB, without proper justification, that should also trigger a complaint to the AB.

As for the scenario laid out by the OP, nothing prevents the accepting CB to issue an ISO 9001:2008 certificate to the organization with the same validity of the issuing CB certificate after a pre-transfer review. So, if the issuing CB revokes the certificate, the registrant would have another certificate issued by the incoming (accepting) CB.

Take your current situation and ask CB-B to adopt as is till next certification audit. CB-B shall make this smooth transition happen,as he is the business winner.

Update: XYZ Company notified CB-A of the plan to use CB-B. CB-A was gracious, promised to follow procedures and offered any help, if requested. No muss, no fuss. Fear of certificate cancellation was unfounded. Thank you, Covers.:applause:
