TS 16949 - 7.4.1.2 requirement and customer waiver - How can I argue this clause?

We are ts 16949 certified company, a third party auditor issue us a non conformance for the clause 7.4.1.2 reason is one of my supplier still QS9000 and didn’t meet or comply to the second note (unless otherwise specified by the customer), and my customer is GM, when I request from my supplier to comply, his argument was
He already has waiver by Customer Specific Requirements. How can I argue that or close the N/C.

NOTE The prioritization of suppliers for development depends upon, for example, the supplier’s quality performance and the importance of the product supplied.

Unless otherwise specified by the customer, suppliers to the organization shall be third party registered to ISO 9001:2000 by an accredited third-party certification body.
Is this the note you're referring to?

Where does this stand? If I understand correctly your supplier states they have a waiver from GM that they do not have to comply with the requirements.

If this is correct and you can get a copy, that should satisfy the registrar.

But...if you use this supplier for any other TS subscriber in addition to GM they are then open to the requirement for development again, unless they can show a waiver from all the other customers....

Can you please provide more detail and I'm sure you will get a lot more advice.
