What can be considered a "Post Delivery Activity" (ISO 9001:2015 Clause 8.5)

Intuit: Recalls might be considered under post delivery activities, but as dsanabria pointed out that according to Clause 8.5 this would be an activity obliged under contract review with your customer and not delivering product that does not meet requirements.

If you look at Clause 8.7.1 it says 'This shall also apply to nonconforming products and services detected after delivery ...' From my perspective, this would be a more appropriate Clause to use for recall or correction of product after delivery.

It isn't one or the other. It is BOTH. Just because it also fits in another category doesn't mean you can ignore one of them.

My question spurs from the Federal Trade Commission's Businessperson's Guide to Federal Warranty Law which references implied warranty created by state law.

Implied warranties are warranties according to my business law professors. Further if it is no more than an understanding that if the customer has a problem with the product or service you will take care of it that would be a warranty. That alone would make it difficult to claim exclusion.

It should be mentioned that there really is no need to claim non-applicability (exclusion) to 8.5.5.

It states that you need to meet requirements for post-delivery activities associated with your products and services. To me that means that you don't worry about it unless the need comes up. Then it goes on to say that when the extent of post-delivery activities are being determined that you shall consider and then goes into an a to e list of topics to consider.

So you don't worry about it until it come up and when it does you consider the a to e topics.

There are two shalls here. First to meet requirements for post-delivery activity. Second to consider topics from the list when it does come up.

Not a difficult thing to handle should a post-delivery activity come to light.

Shipping delivers the product so “controlled shipping” is not a post delivery activity.

Managing accounts receivable may be a post delivery activity as part of the invoicing process.

So, clause 9.1.2 ISO 9001:2015 - monitoring customer satisfaction (for a specific product / service delivery) - is a post-delivery activity? Interesting....
