Which clause would best fit this Nonconformance? (Supplier Related)

Hello!

I am an internal auditor to an organization that is certified to ISO 9001:2015, IATF16949:2016, and AS9100D:2016.

I wont go into the specifics, but, we test some of our supplier product through the use of a spectrometer.

When covering receiving inspection for all three standards (ISO,IATF,AS), when reviewing records, I found that
some test records showed the vendors product to be out of tolerance, however, since it was so minimal, they decided to continue to use the product and did not communicate the information with the supplier. This in term would make our product not conform to our customer requirements.

Which clause would this NCR best be suited for?

Right now i am looking at 2 nonconformities:

ISO 9001:2015 8.7.1: The organization shall deal with nonconforming out puts through segregation, containment, return, or suspension of provision of products and services.- MAJOR

ISO 9001:2015 8.4.1: The organization shall ensure that externally provided processes, products, and services conform to requirements.- MINOR

Which would be the best? Would both clauses be written up against? Is there other better clauses that would fit this finding better?

I think I would go one question further. How where they authorized to use the nonconforming material? If it was approved to use as is, there is nothing that requires segregation etc. or supplier notification.

This in term would make our product not conform to our customer requirements.
If the situation really means that your customer could reject the product, based on this (as you put it) minimal out of spec condition, the disposition of the incoming piece of hardware should also involve the customer(s). Any risk based thinking would tell you that.

Why run the risk the accepting the part AS IS and might have to deal with with a customer reject, later on?
