Who is responsible for Control of Outsourcing?

#1
#1 – The Customer – builds Military Components Painted to MIL Specs
#2 - Supplier Company – builds the Customer’s desired product, less the final paint
#3 - Outsourcing Provider – the painting business who normally deals with #1 on other products as well as costing of this project. (To #2, #3 is a business appearing with little quality control. Logistically, #3 is located much closer to #1.)

The Scenario:
#1 orders by contract the desired product that #2 can produce, less painting due to #2’s inability to paint the product to the MIL Specs., plus this not being value added with their normal painting operations.

#2 agrees in contract with #1 that the product be drop-shipped to #3 contract painter who #1 uses regularly for their own products. All MIL Specs. have been supplied to #3 by #1 previously, and #2 has no knowledge of the actual specs. This final painted product produced by #3 is always sent directly to #1.

The Problem:
#1 receives from #3 the final product and finds that it has limited operating capacity due to #3 ineffectively applying proper masking.

In the past, #1 rejected this nonconforming product, requested a RMA from #2, returned to #2 and expected them to remove excess paint and fix the problem, which #2 did. #2 then sent an invoice to #3 for the RMA repair.

Now, #1 is dealing directly with #3 with the problem and returns to them for removal of the excess paint.

#2 has no direct contact with #3 other than performing the drop shipment as specified by #1. All #2 has from #3 is a requested Supplier Profile/Quality Evaluation form completed by #3’s management.

Question:
1. Who should now be the controller of outsourcing to #3, per ISO 9001:2008, #1 or #2?

Just to clarify - Who writes the Purchase Order to #3? Who writes the check to #3 to pay for services rendered?

Then my feeling is that #1 is responsible for the flow down of requirements. This should leave you completely out of any rework involving subcontracted services unless this was a stipulation in the purchase order to your company. Now all you have to do is convince #1 of that. ;)

Yep, technically and legally it will be #1, but realistically #2 will probably get hammered especially if it's a cost plus-award fee contract. I've personally been down this trail and the gov't COR, ACOR or whatever the gov't person is who is the actual decison maker will lay off responsibility to #2. (After 18 years of gov't logistics contracting trust me)
