Who was present when the nonconformance was initially observed, and when it was presented at the closing meeting? Was it fully appreciated and understood at the time, by those present, exactly what the issue was? The auditor should have made it very clear with his spoken words and those on the NCR paperwork itself, but sadly this does not always happen - but you as the client should be prepared to ask for clarity, and even for the form to be re-worded before signing to accept it.
When the repeat occurrence was raised, was it the same auditor? Was he/she asked to clarify what was the issue that caused a repeat to be raised, and again was this quite clearly stated? Sounds like it wasn't.
